These terms set out the basis on which PO Performance Ltd sells goods through this website. Please read them before ordering. By placing an order, you agree to these terms.

2. Definitions
- "We", "us", "our" means PO Performance Ltd.
- "You" means the person or business placing an order.
- "Consumer" means an individual buying wholly or mainly outside their trade, business, craft or profession.
- "Business customer" means anyone who is not a Consumer.
- "Goods" means the products we supply.
3. Website Use
All content on this website, including text, images, product photography and logos, is owned by us or our suppliers and is protected by copyright. You may not reproduce, republish or use it commercially without our written permission.
You agree not to misuse this website, including attempting to gain unauthorised access, introducing malicious code, or scraping content in bulk.
4. Placing an Order
Orders may be placed through this website, by email, by phone or by WhatsApp. Product listings are an invitation to treat, not an offer to sell.
When you place an order, you will receive an acknowledgement email. This confirms we have received your order — it does not create a contract. A contract is formed only when we send you a dispatch confirmation, or, for made-to-order goods, when we confirm the order has been placed with the manufacturer.
We may decline an order if the goods are unavailable, if we cannot verify your payment or address, if the item was mispriced, or if we believe the goods are unsuitable for your stated application.
5. Pricing and Payment
Prices are shown in pounds sterling and include UK VAT where applicable. Delivery charges are shown separately at checkout before you pay.
We take care to price accurately, but with a catalogue of this size errors can occur. If we discover a pricing error before dispatch, we will contact you to confirm whether you wish to proceed at the correct price or cancel. We will not be obliged to supply goods at an incorrect price.
Prices may change without notice, but the price applicable to your order is the price shown at the time you place it.
Payment is taken in full at the time of ordering, via the methods shown at checkout. Goods remain our property until payment has cleared in full.
6. Delivery
Full delivery information, including carriers, timescales and costs, is set out on our Delivery & Returns page, which forms part of these terms.
Delivery timescales are estimates. Where no specific date has been agreed, we will deliver without undue delay and in any event within 30 days of the contract being formed, unless the goods are made to order, in which case the lead time shown at the point of sale applies.
Risk in the goods passes to you on delivery. If you have asked us to leave a parcel in a safe place or with a neighbour, risk passes when it is delivered as instructed.
7. Customs, Duties and Import VAT
Orders delivered outside the United Kingdom may be subject to import duties, taxes and clearance fees in the destination country. These charges are not included in our prices or delivery costs and are your responsibility. We cannot predict or reimburse them.
It is your responsibility to check import regulations in your country before ordering. Delays caused by customs are outside our control.
If a shipment is refused or returned because import charges were not paid, we will refund the value of the goods less any return carriage and handling costs we incur.
8. Your Right to Cancel (Consumers)
If you are a Consumer, you have the right to cancel your order within 14 days of the day you (or someone you nominate) receive the goods, without giving a reason. If your order arrives in instalments, the period runs from receipt of the last item.
To cancel, tell us clearly before the 14 days expire — email info@poperformance.co.uk with your order number. You then have a further 14 days to return the goods to us.
We will refund the price of the goods and the standard outbound delivery charge within 14 days of receiving the goods back (or of receiving proof you have sent them, whichever is sooner). If you chose an express or upgraded delivery service, we refund only the cost of our standard service.
Return carriage. Unless the goods are faulty or incorrectly supplied, you pay the cost of returning them. We recommend a tracked, insured service — the goods are your responsibility until they reach us.
Reduction in refund. You may handle the goods as you would in a shop to check their nature, characteristics and function. If the goods are returned in a condition showing more than this — for example a clutch disc that has been mounted, components that have been test fitted, parts with tool or thread marks, or items missing their original packaging — we may reduce your refund to reflect the loss in value. Where a component cannot be resold as new, this reduction may be substantial.
9. Made-to-Order and Bespoke Goods
The statutory right to cancel does not apply to goods that are made to your own specification or are clearly personalised.
Where this applies to a product, it is stated clearly on the product page before you buy, and we will confirm it in writing before manufacture begins. Once manufacture has started, these orders cannot be cancelled.
Goods that are simply not held in UK stock and are ordered in from a manufacturer are not bespoke, and your right to cancel under section 8 applies to them in the normal way.
10. Faulty or Incorrectly Supplied Goods
Nothing in these terms affects your statutory rights. Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality.
If goods are faulty or not as described:
- within 30 days of delivery you may reject them for a full refund;
- after 30 days and within six months, you are entitled to a repair or replacement and, if that is not possible, a refund.
Contact us with your order number and photographs, and we will arrange collection or reimburse reasonable return postage.
This does not cover damage caused by incorrect installation, modification, accident, neglect, or use beyond the manufacturer's stated torque, power or application limits.
11. Warranty
Goods are covered by the manufacturer's warranty where one is offered. Warranty terms, duration and exclusions are set by the manufacturer, and we will assist you in pursuing a claim.
Manufacturer warranties commonly exclude components used in competition. This does not affect your statutory rights against us as the seller.
12. Suitability, Fitment and Competition Use
Many of the products we sell are intended for motorsport and competition use and may not be legal for use on public roads. It is your responsibility to ensure any part you buy is legal and appropriate for your intended use and complies with the regulations of any series you compete in.
We provide fitment guidance in good faith based on the information you give us. You are responsible for confirming that a part suits your chassis, engine, gearbox and specification. If in doubt, contact us before ordering.
We strongly recommend that safety-critical components — including clutches, flywheels, braking and steering parts — are fitted by a competent professional and torqued to the manufacturer's specification.
13. Business Customers
Sections 8 and 10 set out rights that apply to Consumers only. If you are buying in the course of a business, the following applies instead:
- The statutory right to cancel does not apply.
- Returns are accepted at our discretion, within 14 days of delivery, for unused goods in original resaleable packaging, and are subject to a 10% administration and restocking fee.
- Return carriage is at your expense.
- Special-order and made-to-order items may be non-returnable where the manufacturer will not accept them back.
- Our liability to you is limited to the price paid for the goods.
14. Our Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights as a Consumer, or for anything else that cannot lawfully be limited or excluded.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of use of a vehicle, loss of race or event entry fees, recovery costs, or costs of fitting or removing goods.
Where you are a Consumer, we are liable for loss that is a foreseeable result of our breach, and our total liability will not exceed the price paid for the goods except where the law requires otherwise.
15. Events Outside Our Control
We are not liable for delays or failure to perform caused by events outside our reasonable control, including carrier disruption, manufacturer delays, customs, extreme weather, industrial action or utility failure. We will contact you and, if the delay is substantial, you may cancel and receive a refund for undelivered goods.
16. Complaints
If something has gone wrong, email info@poperformance.co.uk with your order number. We aim to acknowledge complaints within 2 working days and resolve them within 14 days.
17. Data Protection
We process personal data in accordance with UK GDPR and the Data Protection Act 2018.
18. Changes to These Terms
We may update these terms from time to time. The version in force at the time you place your order is the version that applies to your contract.
19. Governing Law
These terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a Consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
